These Terms of Service ("Terms") govern your access to and use of the websites, dashboard, API, proxy gateway, and related services (collectively, the "Services") provided by QualityProxy Inc. ("QualityProxy", "we", "us", or "our").

By creating an account, accessing the Services, or routing traffic through our proxy gateway, you agree to be bound by these Terms and our Acceptable Use Policy, Privacy Policy, and Refund Policy, each incorporated by reference. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree to these Terms, you may not access or use the Services.

QualityProxy provides proxy infrastructure including residential, datacenter, mobile, and premium residential IP routing through our gateway at gw.qualityproxy.com. Services include account management, usage analytics, API access, documentation, and customer support.

We may modify, suspend, or discontinue any aspect of the Services at any time. We will use commercially reasonable efforts to provide advance notice of material changes affecting paid customers.

You must provide accurate registration information and maintain the confidentiality of your credentials. You are responsible for all activity under your account, including traffic routed through your gateway credentials and API keys.

You must notify us immediately at security@qualityproxy.com of any unauthorized access or suspected credential compromise. We reserve the right to suspend accounts exhibiting suspicious activity to protect the network and other customers.

QualityProxy operates on a pay-as-you-go model unless otherwise agreed in a written enterprise agreement. Bandwidth is measured as bytes transmitted through the gateway including request and response payloads.

Prices displayed at purchase apply to that transaction. We may change pricing for future purchases with reasonable notice. Purchased traffic does not expire while your account remains in good standing.

You authorize us to charge your selected payment method for purchases, auto-recharge events if enabled, and applicable taxes. Enterprise customers may receive invoice billing under separate terms.

Your use of the Services must comply with our Acceptable Use Policy, applicable laws, and the terms of websites you access through the Services. You are solely responsible for ensuring your use cases are lawful and authorized.

We may investigate violations and suspend or terminate accounts without refund for material breaches, including illegal activity, credential stuffing, malware distribution, or circumvention of sanctions.

QualityProxy retains all rights in the Services, software, documentation, trademarks, and network infrastructure. You receive a limited, non-exclusive, non-transferable license to use the Services during the term of your account.

You retain ownership of data you collect through your applications. You grant QualityProxy a limited license to process account and usage data as necessary to provide and improve the Services.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted access, specific success rates on third-party websites, or compatibility with every target. Third-party sites may block, rate-limit, or change behavior without notice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUALITYPROXY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

Our aggregate liability for any claim arising from these Terms or the Services shall not exceed the greater of (a) amounts paid by you to QualityProxy in the twelve months preceding the claim or (b) one hundred U.S. dollars ($100).

You agree to indemnify and hold harmless QualityProxy, its officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your data collection activities, or your violation of these Terms or applicable law.

You may close your account at any time through the dashboard or by contacting support. We may suspend or terminate access for violation of these Terms, non-payment, or to comply with legal requirements.

Upon termination, your right to use the Services ceases immediately. Provisions that by nature should survive termination—including payment obligations, disclaimers, limitation of liability, and indemnification—shall survive.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction therein.

For enterprise customers, alternative dispute resolution or governing law may be specified in a signed Master Services Agreement.

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date and, where appropriate, notified via email or dashboard announcement. Continued use after changes constitutes acceptance.
